Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.

The situation stems from a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in immigration custody.

In her order, the judge noted that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The court proceedings center on conflicting claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in Tennessee.

The judge, who was hearing his challenge to deportation in a Maryland district court, determined that he must now comply with the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
